Welcome to Pregnancy AI, a mobile application and service provided by Baby World AI Ltd ("us", "we", or "our"), a company registered in London, United Kingdom. Please read this End User License Agreement ("EULA" or "Agreement") carefully before using our mobile application (the "App" or "Application").

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you disagree with any part of these terms, you may not access or use the App.

You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are 18 years of age or older.

2. LICENSE GRANT

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

3. SUBSCRIPTION TERMS

3.1 Subscription Plans

The App offers the following subscription options:

• Monthly Premium: £3.99/month
• Yearly Premium: £39.99/year

3.2 Payment and Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscriptions and turn off auto-renewal in your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

3.3 Cancellation

• You may cancel your subscription at any time through your App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds will be provided for partial subscription periods

3.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will be communicated in advance and will take effect at your next renewal.

4. MINI-ME FEATURE

The App offers a "Mini-Me" feature, which is a consumable in-app purchase that allows you to generate a prediction of what your baby may look like based on uploaded photos.

• Mini-Me purchases are one-time, consumable purchases
• Once used, you must purchase Mini-Me again to generate additional predictions
• Mini-Me purchases are non-refundable except as required by law
• Mini-Me is provided for entertainment purposes only

5. OWNERSHIP OF UPLOADED CONTENT

5.1 License to User Content

By uploading images of ultrasound scans, photos, or other content to the App, you grant us a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and display such content for the following purposes:

• Providing and improving the Service
• Training and improving our AI models
• Research and development
• Commercial purposes related to the Service

5.2 Use of Images for AI Training

We store the images you upload to help train our AI model, aiming to enhance and refine the services we provide. By using the App and uploading your images, you give us permission to use these images for this purpose. We appreciate your contribution to improving Pregnancy AI, making it more accurate and enjoyable for everyone.

5.3 Your Representations

You represent and warrant that:

• You own or have the necessary rights to upload the content
• The uploaded content does not violate any third-party rights
• You have consent from any individuals depicted in photos

6. USE OF COOKIES AND TRACKING

We use cookies and similar tracking technologies to track activity in our App and enhance your experience. By using the App, you consent to the use of cookies in accordance with our Privacy Policy.

7. AI PREDICTIONS AND ACCURACY

7.1 Entertainment Purpose

The AI predictions provided by the App, including gender predictions and Mini-Me features, are for entertainment purposes only. You acknowledge that:

• The AI is continuously learning and improving its accuracy
• Predictions should not be regarded as definitive or relied upon for any serious purposes
• For information on the latest model accuracy, please refer to our Whitepaper

7.2 No Guarantee of Accuracy

We do not guarantee the accuracy of any AI predictions. Results may vary, and predictions should not be used as a substitute for professional medical advice or diagnostic testing.

8. MEDICAL DISCLAIMER

THE APP IS NOT PROVIDED BY MEDICAL PROFESSIONALS. THE CONTENT IN OUR APP, INCLUDING ALL AI PREDICTIONS, IS FOR ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE CONSIDERED MEDICAL ADVICE.

• Do not use the App as a substitute for professional medical advice, diagnosis, or treatment
• Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition
• Never disregard professional medical advice or delay seeking it because of information obtained through the App
• If you think you may have a medical emergency, call your doctor or emergency services immediately

9. REFUND POLICY

9.1 Prediction Accuracy Guarantee

If you can provide a birth certificate proving that our AI gender prediction was incorrect, and the birth date matches your stated due date within six weeks, we will issue a full refund of the gender prediction purchase price. active subscription for the billing period in which the prediction was made. This guarantee only applies to users with an active Premium subscription at the time the prediction was generated.

9.2 Refund Process

• Contact us at hello@babyworld.ai with your birth certificate and relevant details
• Refunds are subject to our review and approval of provided documents
• Processing may take up to 30 days
• This offer does not apply to Mini-Me purchases

9.3 Apple Refunds

For all other refund requests related to App Store purchases, please contact Apple directly through your App Store account.

10. RESTRICTIONS ON USE

You agree NOT to:

• Modify, adapt, translate, or reverse engineer the App
• Remove any copyright, trademark, or other proprietary notices
• Use the App for any unlawful purpose
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to any portion of the App
• Use the App in any manner that could damage, disable, or impair the Service
• Use any automated system to access the App
• Resell or commercially exploit the App or its content

11. PERSONAL DATA AND PRIVACY

11.1 Data Collection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR).

11.2 Data Removal

If you wish to have your personal data removed from our records, please contact us at hello@babyworld.ai. We will process your request in accordance with applicable data protection laws within 30 days.

11.3 Data Security

While we implement reasonable security measures, no system is completely secure. You acknowledge that you provide information at your own risk.

12. INTELLECTUAL PROPERTY

The App and its original content, features, and functionality are owned by Baby World AI Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

13. TERMINATION

13.1 Termination by You

You may terminate this EULA at any time by:

• Deleting the App from your device
• Canceling your subscription through the App Store
• Contacting us to request account deletion

13.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of this EULA
• Fraudulent or illegal activity
• At our sole discretion

13.3 Effect of Termination

Upon termination:

• Your right to use the App will cease immediately
• You must delete the App from all devices
• Provisions that by their nature should survive termination will remain in effect

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM YOUR USE OF THE APP OR RELIANCE ON AI PREDICTIONS
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM
• SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS ON LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU

15. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any errors will be corrected
• The App or servers are free of viruses or harmful components
• Results obtained from the App will be accurate or reliable

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Baby World AI Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of this EULA
• Your violation of any third-party rights
• Content you upload to the App

17. CHANGES TO THIS EULA

We reserve the right to modify or replace this EULA at any time at our sole discretion. We will provide notice of material changes by:

• Posting the updated EULA in the App
• Updating the "Last Updated" date
• Sending an email notification (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the revised EULA. If you do not agree to the changes, you must stop using the App and cancel your subscription.

18. GOVERNING LAW AND JURISDICTION

18.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

18.2 Jurisdiction

Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18.3 Apple Terms

This EULA is between you and Baby World AI Ltd only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

19. THIRD-PARTY BENEFICIARY

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this EULA, and Apple has the right to enforce this EULA against you.

20. SEVERABILITY

If any provision of this EULA is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. ENTIRE AGREEMENT

This EULA constitutes the entire agreement between you and Baby World AI Ltd regarding the App and supersedes all prior agreements and understandings.

By downloading, installing, or using the Pregnancy AI App, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
